If a trademark owner predates your use of your trademark in the United States, for similar products, he may be deemed to be the senior user of the mark and thereby prevent you from using your mark in US Commerce.

 

Trademarks that are not federally registered will not appear in the USPTO’s Trademark Electronic Search System (TESS) database, yet they may prevent the use of your mark.
